Two legal agreements have recently been removed with the approval of the Council. Situations change over time and what was once considered necessary can be overtaken by other events. We have recently reviewed cases on behalf of clients to see if legal agreements are still needed or if they can be discharged (removed). The legal agreement remains with a property history and will be revealed through searches, in some cases this can cause complications and it may be helpful to seek to remove them. In both cases the agreement related to restrictions on use that were no longer valid.
By reviewing the original purpose of an agreement and analysing what has happened over time it is possible to see if they can be removed to simplify matters. In the most recent cases we have concluded that the original purpose of the agreements has been overtaken by more recent decisions at the same site or changes around the site. This requires the agreement of the Council and therefore a convincing case needs to be established. Please contact us if you have cases that would benefit from a review.
