An old Section 106 agreement has recently been discharged as it was demonstrated to be no longer relevant. Sometimes it is necessary to review legal agreements to see if the original purpose is still being served. As situations and planning policy changes it can sometimes mean that legal agreements are no longer necessary or relevant. In this case it was shown that the need for a link between different uses was no longer relevant as planning permissions had invalidated the purpose of the legal agreement. As there was no longer a need for the restriction due to a change in circumstances the legal agreement was discharged.
It is often useful to review a planning decisions for sites with extensive histories.
